In view of the utmost importance attached to the enhancement of women's status in all walks of life and to enable them to lead a normal family life as also to ensure the education and welfare of the ·children, guidelines were issued by DOP&T in O.M No. 28034/7/86-Estt.(A) dated 3.4.86 and No.28034/2/97-Estt.(A) dated 12.6.97 for posting of husband and wife who are in Government service, at the same station. Department had on 23.8.2004 issued instructions to all Mins.lDeptts. to follow the above guidelines in letter and spirit.

 2. In the context of the need to make concerted efforts to increase representation of women in Central Government jobs, these guidelines have been reviewed to see whether the instructions could be made mandatory. It has been decided that when both spouses are in same Central Service or working in same Deptt. and if posts are available, they may mandatorily be posted at the same station. It is also necessary to make the provisions at Paras 3(iv) and (vi) of the a.M. dated 3.4.86 stronger as it is not always necessary that the service to which the spouse with longer service belongs has adequate number of posts and posting to the nearest station by either of the Department may become necessary.

 3. On the basis of the 6 th CPC Report, Govt. servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age. On similar lines, provisions of a.M. dated 12.6.97 have been amended. All India Services, namely lAS, IPS and Indian Forest Service (Group 'A'); The spouse may be transferred to the same cadre by providing for a cadre transfer of one spouse to the Cadre of the other spouse, on the request of the member of service subject to the member of service not being posted under this process to his/her home cadre. Postings within the Cadre will, of course, fall within the purview of the State Govt.

(ii) Where one spouse belongs to one of the All India Services and the other spouse belongs' to one of the Central Services:- The cadre controlling authority of the Central Service may post the officer to the station or if there is no post in that station, to the State where the other spouse belonging to the All India service is posted. (iii) Where the spouses belong to the same Central Service: The Cadre controlling authority may post the spouses to the same station.

(iv) Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service:- The spouse with the longer service at a station may apply to his/her appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station to the nearest station where the post exists. In case that authority, after consideration of the request, is not in a position to accede to the request, on the basis of non-availability of vacant post, the spouse with lesser service may apply to the appropriate cadre authority accordingly, and that authority will consider such requests for posting the said officer to the station or if there is no post in that station to the nearest station where the post exists. (v) Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertaking: The spouse employed under the Public Sector Undertaking may apply to the competent authority and said authority may post the said officer to the station, or if there is no post under the PSU in that station, to the State where the other spouse is posted
. (vi) Where one spouse belongs to a Central Service and the other spouse belongs to a PSU:- The spouse employed under the PSU 'may apply to the competent authority and the said authority may post the officer to the station or if there is no post under the PSU in that station, to the station nearest to the station where the other spouse is posted. If, however, the request cannot be granted because the PSU has no post in the said station, then the spouse belonging to the Central Service may apply to the appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station, to the station nearest to the station where the spouse employed under PSU is posted.\
 (vii) Where one spouse is employed under the Central Govt. and the other spouse is employed under the state Govt.:- The spouse employed under the Central Govt. may apply to the competent authority and the competent authority may post the said officer to the station or if there is no post in that station to the State where the other spouse is posted
. (viii) "The husband & wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be applicable to the Govt. servant.
 5. Complaints are sometimes received that even if posts are available in the station of posting of the spouse, the administrative authorities do not accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefor, may be communicated to the employee.
 6. Although, normal channels of representations/complaints redressal mechanism exist in the Min.lDeptts., added safeguards to prevent noncompliance may be provided by ensuring that the complaints against nonadherence to the instructions are be decided by the authorities at least one level above the authorities which took the original decision when they are below the level of secretary to the Govt. of India/Head of the PSU concerned and all such representations are considered and disposed off in time bound manner. It has been decided that the holidays as specified in the Annexure —I to this O.M. will be observed in the Administrative Offices of the Central Government located at Delhi/New Delhi during the year 2017. In addition, each employee will also be allowed to avail himself / herself of any two holidays to be chosen by him/her out of the list or Restricted Holidays in Annexure — II.
2.Central Government Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays as per para 3. below:

3.1. The final list applicable uniformly to Central Government offices within the concerned State shan be notified accordingly and no change can be carried out thereafter. It is also clarified that no change is permissible in regard to festivals and dates as indicate.

3.2 No substitute holiday should be allowed if any of the festival holidays initially declared subsequently happens to fall on a weekly off or any other non-working day or in the event of more than one festivals falling on the same day.
4. The list of Restricted Holidays appended to this O.M. is meant for Central Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.
5.1 For offices in Delhi / New Delhi, any change in the date of holidays in respect of Idu’l Fitr, Idu’l Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi (DCP, Special Branch, Delhi Police).
5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idu’l Fitr, Idu’l Zuha, Muharram and Id-e-Milad.
5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through P.I .B /T.V. /A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.
6. During 2017, Diwali (Deepavali) falls on Thursday , October 19, 2017 (Ashvina 28). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on “Narakachaturdasi Day”. In view of this, there is no objection if holiday on account of Deepavali is observed on- “Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government.
7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi’s birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2017, subject to para 3.2 above.
8. Union Territory Administrations shall decide the list of holidays in terms of Instructions issued in this regard by the Ministry of Home Affairs.
9. In respect of Indian Missions abroad, the number of holidays may be notified in accordance with the instructions contained in this Department’s O.M. No.12/5/2002-JCA dated 17th December, 2002. In other words, they will have the option to select 11(Eleven) holidays of their own only after including in the list, three National Holidays and Mahavir Jayanti, Id-ulZuha (Bakrid), Vijay Dashmi, Muharram, Guru Nanak Birthday and Miladun-Nabi(Id-e-Milad (Birthday of Prophet Mohammad) included in the list of compulsory holidays and falling on day of weekly off.
10. In respect of Banks, the holidays shall be regulated in terms of the extant instructions issued by the Department of Financial Services, Ministry of Finance.

i) Where the Autonomous Institutions have adopted the provisions of FR 56 (j), Administrative Ministry may ensure that they are strictly followed ;
(ii) Where the Autonomous Institutions have similar provisions in their rule books, the Administrative Ministry may ensure that they are followed in letter and spirit ; and
(iii) Where no such provisions exist, the Administrative Ministry may ensure that the action is taken to put in place such rules as may be necessary.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 – Fulfillment of procedural requirements.
This Department is in receipt of a number of references regarding the procedural difficulties faced by the Government employees in application and settlement of the LTC claims. Sometimes, the Government servants claim that failure to follow the correct procedure was on account of a lack of knowledge of the rules/instructions. It is alleged that in some cases, processing of LTC claims takes unduly long time, particularly when the employee and the sanctioning authorities are located at different stations.
2. To remove these bottlenecks, it has been decided to simplify the procedure of application and make the procedure of processing of LTC claims time bound. The following time-limits shall be followed while processing the LTC applications/claims of the Government servants.

*(a) Additional 3 days transit-time may be allowed in cases where the place of posting of the Government employees is away from their Headquarters, The Government employee may proceed on LTC after action on S.No.1 .
(b) Efforts should be made to reduce the duration of processing of LTC applications/claims at the earliest. The maximum time limit should be strictly adhered to and non —compliance of time limit should be adequately explained
3. Under CCS (LTC) Rules, the Government servants are required to inform their Controlling Officer before the journey(s) on LTC to be undertaken. It has now been decided that the Leave Sanctioning Authority shall obtain a self-certification from the employee regarding the proposed LTC journey. The proforma for self-certification has been annexed with this O.M.
4. In addition to the above, it has been decided that whenever a Government servant applies for LTC, he/she should be provided with a copy of the guidelines (enclosed) which needs to be followed while availing LTC.
5. Employees may be encouraged to share interesting insights and pictures, if any, of the destination he/she visited while availing LTC in an appropriate forum.

New Delhi: Several members in a parliamentary panel have pitched for quick implementation of the Centre’s proposed move to double salary and allowances of MPs and insisted that report of any government-constituted committee on the matter must be channelled through it.

At a meeting of the Joint Committee on Salaries and Allowances of Members of Parliament on Wednesday, a number of MPs favoured routing of report of any independent mechanism, being set up to review salary and allowances of MPs, through the panel, which draws its power from Parliament, sources said.
They said before the report is handed over to the government it should be vetted by the committee. The members also insisted their pay and perks should be equal to that of the Cabinet Secretary, they said.
The Centre had in September last proposed to constitute a three-member Emoluments Commission to determine salary and allowances of Members of Parliament and it was endorsed at the two-day All India Whips Conference on September 29 and 30.
The proposal had come in the backdrop of a controversy over a parliamentary panel’s recommendations in June last to double the pay and perks of lawmakers. The Joint Committee, headed by BJP MP Yogi Adityanath, in its meetings in May and July last year had opined that there was need for an independent system/mechanism for review of salary and allowances of MPs.
The committee suggested that while considering enhancement of salary, parameters like inflation and hike in the salary of government officials should be taken into consideration. The panel also asked the Parliamentary Affairs Ministry to place before it the proposal.
The Ministry representatives on Wednesday told the panel that a cabinet note has been prepared for doubling salary and allowances of MPs.
To this, the panel members asked them to place the note before the Union Cabinet soon for its early approval so the proposals become a reality in this Union Budget. The Budget session of Parliament begins on February 23 and the Union Budget will be presented on February 29.
An MP gets a salary of Rs 50,000 per month. In addition, Rs 2,000 per day is paid as daily allowance when an MP signs the register while attending Parliament sessions or House committee meetings.
An MP is also entitled to Rs 45,000 constituency allowance every month — Rs 15,000 for stationery and Rs 30,000 to employ secretarial assistance staff.
In their sitting on October 20 last year, the committee decided to enhance the amount of Constituency Allowance from the present Rs 45,000 to Rs 75,000, which required an amendment in rules.
MPs are also entitled for government accommodation, air travel and train travel facilities, besides three landline telephone connections and two mobile phones. They also get a loan of Rs 4 lakh to buy a vehicle.

The undersigned is directed to say that in connection with the Bye Election to the State Legislative Assemblies of Uttar Pradesh, Madhya Pradesh, Karnataka, Bihar, Telangana, Maharashtra, Punjab and Tripura, scheduled to be held in February, 2016, the following guidelines, already issued by this Department vide Office Memorandum No. 12/14/99-JCA dated 10.10.2001, have to be followed inrespect of the Central Government Offices, including Industrial Establishments in the States : –
In connection with bye-election to State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee, who is ordinarily a resident of constituency and registered as a voter, but employed in any Central Government Organization/ Industrial Establishment located outside the constituency having the bye-election.
2. The above instructions may please be brought to the notice of all concerned.

Guidelines for closure of Central Government Offices including industrial establishments of the Central Government in connection with general elections/bye-elections to Parliament/State Assemblies and other elections to local bodies.

I am directed to forward herewith a copy of the O.M. No. 12/4/86- CA, dated the 9th March, 1987 from the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), New Delhi on the above subject, for your information. The Guideline contained therein may be followed in all future elections.

Instructions already exist regulating closure of Central Government of offices on the polling day (S) in connection with various elections and the same have been consolidated in the enclosed statement (Annexure) for information and necessary action in connection with the ensuing general elections to constitute new Assemblies in the State of J & K., Kerala, West Bengal and other bye-elections being held simultaneously on 23rd march, 1987 and any such elections to be held in future. These instructions are applicable in respect of Central Government industrial establishment also.

Ministry of Finance, etc., are requested to bring these instructions to the notice of the offices or organisations under their jurisdiction for information and necessary action.

Annexure

Guidelines for closure of Central Government offices in connection with election to Parliament/State Assemblies/Local elections.
I. General Elections
to Lok Sabha/State
Assemblies
-I. Facilities/Privileges to Central employees
(a) Holiday/closure of offices-
In connection with General Elections to Lok Sabha or a State Assembly, a local holiday is usually declared by the State Government on the date (s) of polling, if held on day (s) other than Sunday or other closed holiday. When such a holiday is declared, the Central Government offices located in such places should also be closed on the polling day (s) in accordance with the practice adopted by the State Government.

(b) Grant of Special Casual Leave-

Every eligible voter is entitled to be registered in the electoral roll of a constituency in which he ordinarily resides. In some cases, it may happen that the Central Government employee residing, and enrolled as a voter, in a particular place/constituency, say Delhi (where the election is to be held), may be employed in any office located at some other place, say, Faridabad/Ghaziabad, etc., in such cases, the individual Central Government employee may be granted special casual leave, if his office does not happen to be closed on that particular day, to enable him to exercise his franchise.

II.Bye-Elections -
(i) Lok Sabha 

II. (a) Holiday/Closure of offices
State Government normally declares a local holiday in that particular area/constituency on the polling day (s) if the election is held on day (s) other than Sunday/or other closed holidays. Central Government offices may also follow the State practice in such cases.

(b) Grant of Special Casual Leave-

Permissible on the same grounds/circumstances as in the case of general elections [of I(b) above.]
(ii) State Assemblies(a) Holiday/closure of offices-
In bye-election to State Assemblies, Central Government offices should not be closed. It would be sufficient if only those Central Government employees who may be placed on election duty are permitted to absent themselves from office on the polling day (s). All other employees should be given facility to excise their franchise either by way of coming late to office or by being allowed to leave office early or a short absence on that day, subject to the exigencies of the services.

(b) Grant of Special Casual Leave-
Permissible on the grounds/circumstances as in the case of general elections. (of I(b) above.)
III. Panchayat/Corporation.

employees who are bonfire voters and desire to
exercise their franchise should however, offered reasonable facility, subject to the normal exigencies of service, either by way of coming late to office or by being allowed to leave office early or a short absence on that day.

Note :- Heads of Central Government offices located in places outside Delhi may also permit the staff detailed on election duty to remain away from their normal duties on polling day (s) as also on the day (s) required for performing journeys which might be under taken in order to perform such election duty.
